The law relating to working time was introduced on 1 October 1998 following a European directive. The Working Time Regulations 1998 (as amended) cover not just employees but also members of the wider workforce who are classed as workers.

An employee can opt out of the 48-hour working week, in writing; he or she must enter into this opt-out on an individual basis. An opt-out agreement can be included in a worker's statement of terms and conditions. The opt-out agreement must specifically state that the employee is willing to disapply the 48-hour limit imposed by the Working Time Regulations. It will not be sufficient to sign a document agreeing to work, for example, a 52-hour week.
